Not to be too negative, but that's why law has to evolve with us, because over time it will inevitably be used against us if it doesn't change and grow as well. Laws tend to be written to thwart acts or persons deemed unacceptable -- child porn, murder, bank fraud, Jews -- and as such do not encompass all situations, sometimes to laughable extremes. Justice, on the other hand, is the appeal to fairness -- sometimes in direct contravention to the written law, which can be proven unjust and work substantial harm on the population. Rest assured that if you wait for law to protect and preserve your rights, today there would be no such thing as a free American Negro, and gays would be in work camps with mandatory ID chips and their crimes tattooed on their foreheads. So before you go off on 'judicial activism'... remember the Holocaust was perfectly legal. And so were lynchings.
