You and me both. I read Bush v. Gore. And you know what? It doesn’t say anything about who ‘won’ the election. It just says the Florida results can’t be used, can’t be recounted and the election can’t be repeated. So Katharine Harris, the Florida Secretary of State (and Bush’s campaign chair for the state) simply declared him the winner. On that declaration alone, Bush seized power. It was not an election. It was an out-and-out coup. And you can bet not the last one.
I wonder how things would go with a coalition government like a number of other countries have. Instead of the winner-take-all system we now have, with the opposing congress forming paralyzing gridlock, we would have a government made up of any parties that drew more than a certain percentage of the vote. Besides the current two Big Two, laws and policies would require at least the cooperation of smaller groups like the greens, libertarians and tea party.
